This Privacy Policy describes how Silverberry Corporation ("Propheta," "we," "us") collects, uses, discloses, and protects Personal Information when you access or use Propheta.io and related services (the "Service"). This Policy is intended to apply globally, subject to local law requirements. Please also review our Terms of Service and any Promotion Official Rules.

2. Scope

This Policy applies to information we collect when you:

  • visit our website or apps;
  • create an account and use the Service;
  • connect third-party platforms (for example, via API keys or similar credentials);
  • contact support; or
  • participate in promotions, rewards, or leaderboards (where offered).

3. Availability, Restricted Jurisdictions, and Integrity Controls

Propheta is intended to operate globally where permitted by law. Certain features (including Promotions, Rewards, and Leaderboards) may be unavailable or modified in certain jurisdictions.

3.1 Restricted Jurisdictions (Promotions/Rewards/Leaderboards)

As of the Effective Date, Promotions/Rewards/Leaderboards are not offered in:

  • Brazil
  • Italy
  • Japan
  • Australia
  • Ireland
  • plus any jurisdictions designated in-app as restricted.

3.2 Sanctions / Prohibited Locations

The Service or certain features may be unavailable in locations subject to comprehensive sanctions/embargoes (including Cuba, Iran, North Korea, Syria, and any comprehensively sanctioned region/territory), and we may deny access for compliance reasons including sanctions screening.

3.3 U.S. State-Specific Operations

For certain U.S. states (including NY and FL), we may run separate promotion periods and/or separate reward credit pools and apply default caps.

3.4 Geofencing, VPN/Proxy Restrictions, and Verification

We may use IP-based location, device signals, and other measures to enforce restrictions and protect integrity. Using VPNs/proxies to bypass restrictions may result in blocked access, voided participation, forfeiture, or suspension.

4. Information We Collect

We collect information in three ways: (A) you provide it, (B) we collect it automatically, and (C) we receive it from third parties.

4.1 Information you provide

  • Account and profile information (e.g., name, email, phone if provided, username, preferences).
  • Eligibility information (e.g., date of birth, residency confirmations) when required for compliance or integrity.
  • Support communications (e.g., messages, attachments, feedback).
  • Promotion participation data (entries, leaderboard activity).
  • Third-party integration credentials you provide (e.g., API keys/tokens) and related connection settings.

4.2 Information collected automatically

  • Device and usage data (e.g., IP address, device type, browser/OS, app events, logs, crash reports, performance metrics).
  • Approximate location derived from IP/device signals (primarily for fraud prevention and jurisdiction enforcement).
  • Cookies and similar technologies (see Section 9).

4.3 Information from third parties

  • Auth providers (if you choose to sign in through them), consistent with your settings and their policies.
  • Service providers (hosting, analytics, communications, fraud prevention, customer support).
  • Payment processors (transaction status and metadata; payment processors typically handle payment card details).
  • Third-party platforms you connect (limited data necessary to provide the integration you request).

5. How We Use Personal Information

We use Personal Information to:

  • provide, maintain, and improve the Service;
  • create and manage accounts, authenticate users, and provide customer support;
  • enable integrations you request (including using your provided API credentials to interact with third-party platforms);
  • operate promotions/rewards/leaderboards where offered, including scoring and anti-abuse enforcement;
  • detect, prevent, and investigate fraud, abuse, security incidents, and policy violations;
  • enforce jurisdictional restrictions and eligibility requirements;
  • send service-related notices and, where permitted, marketing communications; and
  • comply with legal obligations and respond to lawful requests.

We may also create aggregated or de-identified data that cannot reasonably be used to identify you, and use it for analytics, research, and improving the Service.

6. Legal Bases (EEA/UK and Similar Frameworks)

Where applicable (for example, under GDPR/UK GDPR), we process Personal Information under one or more legal bases, including: (a) contract necessity, (b) legitimate interests (such as security and fraud prevention), (c) consent (where required), and (d) legal obligations.

7. How We Share Personal Information

We may disclose Personal Information to:

  • service providers and processors that help us operate and secure the Service (e.g., hosting, analytics, communications, fraud prevention, customer support);
  • third-party platforms you choose to connect, solely to perform the integration you request and maintain that connection;
  • law enforcement, regulators, courts, or other parties where required by law or to protect rights, safety, and integrity;
  • parties involved in a corporate transaction (e.g., financing, merger, acquisition, or sale of assets), subject to appropriate safeguards; and
  • others with your direction or consent.

We do not sell Personal Information for money. Some jurisdictions define certain online advertising disclosures as "sale" or "sharing"; where applicable, we provide opt-out mechanisms as described in Section 11.

8. International Transfers

Silverberry Corporation is based in Panama. Because we operate globally, your Personal Information may be processed in Panama, the United States, and other countries where we or our service providers operate. Where required, we use appropriate safeguards for cross-border transfers (such as contractual protections).

9. Cookies and Similar Technologies

We use cookies, pixels, SDKs, and similar technologies to operate the Service, provide security, remember preferences, understand usage, and improve performance. Where required by law, we will request consent for non-essential cookies.

Your controls:

  • Adjust browser/device settings to block or delete cookies (note: some features may not function).
  • Use any cookie preferences tool we provide, where available.
  • Opt out of targeted advertising where applicable.

We may not respond to all Do Not Track signals; where required we honor supported signals (e.g., Global Privacy Control).

10. Data Retention

We retain Personal Information only as long as reasonably necessary to provide the Service, maintain security and prevent fraud, comply with legal obligations, resolve disputes, and enforce agreements. Retention periods vary by data type and purpose.

11. Your Rights and Choices

Depending on your location, you may have rights to:

  • request access to and a copy of your Personal Information;
  • request correction of inaccurate information;
  • request deletion (subject to legal and security exceptions);
  • object to or restrict certain processing;
  • request portability; and
  • withdraw consent where processing is based on consent.

11.1 How to exercise your rights

Email compliance@propheta.io from the email associated with your account and include: (i) the request, (ii) the jurisdiction (country/state) you are located in, and (iii) sufficient information for us to verify your identity. We may require additional verification to protect your account.

11.2 U.S. state privacy disclosures (e.g., California and others)

Residents of certain U.S. states may have additional rights including opting out of certain targeted advertising “sale/sharing” and appeals, as required by law.

12. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect Personal Information. No system is completely secure. You are responsible for keeping your credentials confidential and controlling access to your device.

13. Children

The Service is not intended for children. You must be 18+ (or the age of majority where you live) to use certain features. We do not knowingly collect Personal Information from minors.

14. Third-Party Links and Services (Including Connected Platforms)

The Service may link to or integrate with third-party services. Their privacy practices are governed by their own policies. We are not responsible for third-party practices outside our control.

15. Changes to This Policy

We may update this Policy from time to time. Changes are effective when posted with an updated Effective Date/Last Updated date. Your continued use of the Service after changes means you accept the updated Policy to the extent permitted by law.
